1.
When does a case
qualify for licensing enforcement?
For a case to qualify for licensing the arrears owed must be 4x’s the
monthly support obligation and $1,000.00 in arrears, with no payments in
60 days.
2. I have received a 60 day licensing notice
what can I do to avoid further licensing actions?
To avoid further licensing actions CSSD must start to receive monthly
payments through wage withholding or under a payment agreement or after
the 60 day expire the case will be transferred to licensing enforcement.
3. I have received a 150 day licensing notice
what can I do to avoid further licensing actions?
You may request an administrative review on the licensing actions in
writing on the 2nd page of the 150 day notice. CSSD will review and issue a
decision within 30 days.
4. If I am found not incompliance how can I
avoid further licensing actions?
To avoid further licensing actions you must enter into a payment
agreement with CSSD or you must make arrangements for the payments to be
made through wage withholding.
5.
What if I do not agree with CSSD’s administrative review decision on
licensing?
You may file with the court a petition for expedited relief against
licensing actions. The petition for expedited relief form
is enclosed with the licensing administrative review decision. 6.
How is a payment agreement calculated? A payment agreement is based on
the monthly support obligation, interest and a payment towards the arrears.
7. What if I can not afford the amount of the payment
agreement? If you are unable to meet the amount of the payment agreement
you may request a licensing hardship. Once received CSSD can review to possibly
lower the payment agreement amount. Please note that we still have to collect
the monthly support, interest and a payment towards the arrears. If you would
like CSSD to consider lowering your monthly support obligation, you will need to
request a modification.
8. If my license has been suspended how may I have it
released? For CSSD to release your license you will need to enter into a
payment agreement and make the initial payment. You will need to continue
making monthly payments per the payment agreement. If you become delinquent on
your payment agreement your license will be suspended without further
notification. 9. If my license has been suspended
due to me being delinquent on my payment agreement how can I get my license
released?
If your license has been suspended due to you being delinquent on your
payment agreement you will have to catch up all your missed/delinquent payments
and enter into a new payment agreement before CSSD can release your license.
You will need to continue making monthly payments per your new payment
agreement. If you become delinquent on this payment agreement your license will
be suspended without further notice.
10. What if I can not afford to catch up the amount
of my missed/delinquent payments and/or the new payment agreement amount?
If you are unable to make up all your missed/delinquent payments and/or
the new payment agreement amount, you will need to complete a licensing hardship
request form. Once received CSSD can consider lowering the amount you will need
to pay towards your missed/delinquent payments and/or the new payment agreement
amount. 11. If CSSD has a flag on my occupational
license how may I have the flag removed? If you are found to be in
compliance, CSSD will advise the occupational licensing agency to remove the
flag and to allow the license to be renewed or issued.
If you are not in compliance, CSSD must start to receive monthly payments
through wage withholding or under a payment agreement before the flag can be
removed.
If you have been found not in compliance and have never been issued a 150 day
temporary license, the occupational licensing agency may issue you a 150 day
temporary license. If at the end of the 150 days you are found to be in
compliance, CSSD will remove the flag on your occupational license and you may
be issued a full term license.
If you have already been issued a 150 day temporary occupational license or at
the end of the 150 day temporary occupational license you are not in
compliance, CSSD will have to start receive monthly payments through wage
withholding or under a payment agreement before we can remove the flag.
