- Adding a low-income child support calculation for a parent who earns $30,000 (annually) or less;
- Adding criteria on when potential income may be imputed to a parent and the factors to determine the amount of potential income;
- Requiring documentation of current pay and deductions in an annual child support review request;
- Decreasing the de facto custody time from nine to six months to trigger the defense of preclusion to collecting past due child support; and

CHILD SUPPORT GUIDELINES
Civil Rule 90.3
Comments Due by December 19, 2022
Federal law requires a review of each state’s child support guidelines every four years to make sure that the guidelines
result in appropriate amounts of child support. The Chief Justice of the Alaska Supreme Court appointed a special committee to conduct this review of Alaska’s child support guidelines (Civil Rule 90.3).
Last fall, the committee asked for general comments on the guidelines. Now the committee is recommending specific changes to the guidelines and inviting your comments on them.
The recommendations include the following:
- Certain deductions from income are changed –
- the limit on voluntary retirement contributions and a parent’s health insurance premiums would be based on a parent’s total income, not just gross wages and self-employment income,
- a parent could deduct certain life insurance premiums capped at $1,200 annually;
- Adding a low-income child support calculation for a parent who earns $30,000 (annually) or less;
- Adding criteria on when potential income may be imputed to a parent and the factors to determine the amount of potential income;
- Requiring documentation of current pay and deductions in an annual child support review request;
- Decreasing the de facto custody time from nine to six months to trigger the defense of preclusion to collecting past due child support; and
- Increasing from $126,000 to $138,000 the maximum amount of income that will be used in the guidelines’ formulas to calculate the support due from high income earners.
